These Terms of Service (“Terms”) constitute a legally binding agreement between Sivaard Limited (“we”, “us”, “our”) and the Student (if Adult), parent or legal guardian (“you”, “your”) who purchases tutoring services for a child (“the Student”). By booking or paying for tutoring services, you agree to be bound by these Terms.

1. Description of Services
1.1
We provide online tutoring services delivered via live video sessions on Zoom.
1.2
Services may include one to one lessons, group lessons, assessments, and educational materials.
1.3
We reserve the right to modify or update our services at any time.

2. Eligibility
2.1
You must be at least 18 years old and legally authorised to act on behalf of the Student.
2.2
You are responsible for ensuring the Student complies with all behavioural and safety requirements.

3. Booking and Payment
3.1
Lessons must be booked through our Website or through authorised communication with us.
3.2
Payment must be made in advance via Stripe, our secure payment processor.
3.3
We do not store or have access to full payment card details.
3.4
Prices are displayed on the Website and may be updated from time to time.

4. Cancellations and Refunds
4.1 Cooling Off Period
Under the Consumer Contracts Regulations, you may cancel your purchase within 14 days, unless:
a) You request lessons to begin immediately, or
b) The Student attends a lesson within the 14 day period
In such cases, the cooling off right is waived.
4.2 Lesson Cancellations
a) You must provide at least 24 hours’ notice to cancel or reschedule a lesson.
b) Lessons cancelled with insufficient notice are non refundable.
c) If we cancel a lesson, we will offer a rescheduled session or a refund.
4.3 Refunds
Refunds (where applicable) will be processed through Stripe and may take several business days.

5. Behaviour and Conduct
5.1 Student Behaviour
Students must:
a) Treat tutors and peers respectfully
b) Use appropriate language
c) Follow tutor instructions
d) Not record lessons without permission
e) Not share inappropriate content
5.2 Tutor Conduct
Tutors must:
a) Maintain professional boundaries
b) Deliver lessons in a safe and respectful manner
c) Not communicate privately with Students outside approved channels
We reserve the right to remove a Student from a lesson or terminate services for inappropriate behaviour.

6. Safeguarding and Online Safety
6.1
We are committed to safeguarding and child protection. Tutors are required to follow our Safeguarding & Child Protection Policy and Online Safety Policy.
6.2
Lessons may be recorded for safeguarding, training, or quality assurance purposes, with prior notice.
6.3
Parents must ensure the Student participates in lessons from a safe and appropriate environment.

7. Technology Requirements
You are responsible for ensuring the Student has:
a) A stable internet connection
b) A suitable device with camera and microphone
c) A quiet and safe learning environment
We are not liable for disruptions caused by your equipment or internet connection.

8. Intellectual Property
All lesson materials, worksheets, videos, and resources are the intellectual property of Sivaard Limited.
You must not:
a) Copy, distribute, or share materials
b) Use materials for commercial purposes
c) Publish or upload materials online

9. Termination
We may suspend or terminate services if:
a) Payments are not made
b) Behaviour rules are breached
c) Safeguarding concerns arise
d) You violate these Terms
You may discontinue services at any time, but refunds will only be provided in accordance with Section 4.

10. Limitation of Liability
10.1
We are not liable for:
a) Loss of data
b) Technical issues beyond our control
c) Indirect or consequential losses
d) Academic outcomes or exam results
10.2
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
